I see, so when a v3 client attempts to bind with v3 to a v2 server, and gets a protocolError, it has no idea whether the server is v3 or v2, thus it's safest to assume the server is v2 and close/open the connection. Right?

RFC 1777 didn't say how a server should respond to v3.  We included this 
instruction in 2251 based on LDAPv2 server implementation experience.
